Order AMENDING MEMORANDUM AND DENYING PETITION FOR REHEARING AND EN BANC SUGGESTION

The memorandum Disposition filed on October 24, 1995, is amended as follows: delete "and using that land outside the scope of his mining permit" from the first sentence of the Disposition.

The panel has voted to deny the petition for rehearing and to reject the suggestion for a rehearing en banc.

The full court has been advised of the suggestion for an en banc rehearing and no Judge of the court has requested a vote on the suggestion for rehearing en banc. Fed. R. App. P. 35.

The memorandum Disposition is AMENDED, the petition for rehearing is DENIED and the suggestion for rehearing en banc is REJECTED.
