Order AMENDING OPINION

West Publishing Company has kindly called the court's attention to two inadvertent errors on page 16 of the slip opinion in the above case. To remedy those errors, the court now orders as follows:

1. In the first full sentence on page 16 of the slip opinion, the word "third" is substituted for the word "second." The sentence now reads: "The first and third questions are not in issue here."

2. In the fourth full sentence on page 16 of the slip opinion, the word "second" is substituted for the word "third." The sentence now reads: "Like the parties, we focus primarily on the second question."

IT IS SO ORDERED.
