State v. Vansicle

March 3, 1997

STATE OF WASHINGTON, RESPONDENT,
v.
TROY CLINTON VANSICLE, APPELLANT.

Appeal from Superior Court of King County. Docket No: 94-1-08166-3. Date filed: 07/31/96. Judge signing: Hon. Michael C. Hayden.

PER CURIAM. -- Troy VanSickle appeals his conviction of first degree theft. He argues the trial court erred in setting the amount of restitution. He contends that the court ordered him to pay $51, 750 restitution because the court believed he had taken $45,000 from the victim. But VanSickle pleaded guilty to taking a 1988 Porsche which the victim received after VanSickle defaulted on a $45,000 loan. VanSickle asks this court to remand for a new restitution hearing. The State concedes that a new restitution hearing is appropriate because the trial court erred in imposing restitution for the defaulted loan instead of the Porche. Accordingly, the restitution order is vacated and the case is remanded for a new restitution hearing.
