All five members of Department II of the Court considered the matters set on its May 6, 1997, Motion Calendar, and unanimously agreed that the following order be entered. Therefore, Chief Justice Barbara Durham directed that this order be entered:

That the Petition for Review is denied. Respondent's motion for attorney fees is granted. The amount of the attorney fees will be determined by the Supreme Court Commissioner pursuant to RAP 18.1.
