         PETITIONING THE COURT

         To issue a warrant and to incorporate the violation(s) contained in this petition in future proceedings with the violation(s) previously reported to the Court on 09/18/2019 and 10/01/2019.

         The probation officer believes that the offender has violated the following condition(s) of supervision:

         Violation Number Nature of Noncompliance

         4 Standard Condition # 2: After initially reporting to the probation office, you will receive instructions from the Court or the probation officer about how and when you must report to the probation officer, and you must report to the probation officer as directed.

         Supporting Evidence: Mr Heartburg is alleged to have violated his conditions of supervision by failing to report to the probation office as directed on December 9 and 10, 2019.

         On December 6, 2019, the undersigned officer and Mr. Heartburg spoke on the telephone. He was directed to report to the probation office for urinalysis testing on December 9, 2019. Mr. Heartburg failed to report as directed.

         On December 10, 2019, a voice mail and text message were left on Mr. Heartburg's cell phone directing him to report to the probation office. Those messages have gone unanswered.

         Also, on December 10, 2019, the undersigned officer went to Mr. Heartburg's address. His roommates disclosed they have not had any contact with Mr. Heartburg for several days, and are unsure of his whereabouts. A business card was left with instructions to report immediately. Additionally, Mr. Heartburg's roommates have also attempted to reach him by phone and through Facebook, directing him to contact this officer. Those attempts have gone unanswered.

         Mr. Heartburg has not reported or made any effort to contact the undersigned officer, and it appears he has absconded.

         On August 27, 2019, Mr. Heartburg signed his conditions of supervision relative to case number 2:04CR00061-WFN-1, acknowledging an understanding of his conditions of ...
